In Georgia, drivers with a commercial driver's license are held to a higher standard than other drivers. If you are a driver operating a commercial vehicle, you are prohibited from the following:
- Using more than one button on a wireless telecommunication device to start or end a phone call.
- Reaching for wireless telecommunication devices in a way that requires the driver to no longer be able to be secured adequately within a safety belt or be seated in a proper driving position
Penalties For Distracted Driving
The penalties and fines for distracted driving in the state of Georgia are as follows:
First Conviction – You will receive a penalty in the way of a fine that will be no more than $50
Second Conviction – If it is within 24 months of the first Conviction, the fine will be no more than $100
Third Conviction – Within 24 months, the fine will be not any more than $150
One of the biggest things Georgia is doing to help prevent and reduce distracted driving in its state is through the passing of the Hands-Free Georgia Act. With this Act, as of July 1, 2018, drivers in Georgia must obey a whole new set of regulations regarding their cellular devices while driving. Georgia's previous anti-texting law was amended with this law, which, before some drivers and politicians, felt like it never went far enough when it was first enacted.
With the Hands-Free Georgia Act, drivers can still use their cellular devices while driving, but they just cannot physically be holding their phones when operating their motor vehicles. Utilizing a GPS, receiving and making phone calls, and voice-to-text are all still allowed, as long as it is being done hands-free.
